HostTiger, LLC (hereafter referred to as "HostTiger") is a privately held web hosting company. All accounts on our web servers are subject to the terms of service described in this document. Under the terms of this agreement, use of services from HostTiger constitutes agreement to these terms and conditions.

Account Setup

1. New accounts are activated only after passing our fraud screening procedures. Upon activation, you will receive an account welcome email and future invoices on your account renewal date. It is your responsibility to manually login to the customer centre and complete payment prior to the due date. It is also your responsibility to ensure the email address on file is current or up to date.


2. HostTiger is not responsible for service termination or disruption resulting from incorrect /outdated contact information. Providing false contact information of any kind may result in the termination of your account.

Account Cancellation

1. To cancel your account with HostTiger, you MUST submit a request via the customer centre. Please follow the steps posted here.
2. Non-usage of your account does NOT qualify as a request to cancel service(s) and payment for your account.
3. Use of abusive language when communicating with HostTiger staff or users will result in account termination.
4. HostTiger reserves the right to cancel, suspend, or restrict access to an account at any time with or without notice.

• Pirated Software/Warez
• Image Hosting Scripts (similar to Photobucket or Tinypic)
• AutoSurf/PTC/PTS/PPC sites
• IP Scanners
• Bruteforce Programs/Scripts/Applications
• Mail Bombers/Spam Scripts
• Banner-Ad services (commercial banner ad rotation)
• File Dump/Mirror Scripts (similar to rapidshare)
• Commercial Audio Streaming (more than one or two streams)
• Escrow/Bank Debentures
• High-Yield Interest Programs (HYIP) or Related Sites
• Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
• Sale of any controlled substance without prior proof of appropriate permit(s)

Spam Policy (Zero Tolerance)

1. HostTiger is committed to a zero-tolerance, anti-spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either: Over the our network, by customers or any other users of the our network; AND/OR over ANY network- if the message sent advertises or mentions a site hosted on a HostTiger server.


2. We further reserve the right to terminate services, without prior notice, of any customer disregarding this policy. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of Usenet groups, posting obscene or threatening messages while using or referring to an HostTiger email address or web site URL is prohibited. The use of our servers as a mail drop for responses to activities described above is also prohibited.


3. Any account which results in an HostTiger IP being blacklisted will be immediately suspended and/or terminated. A clean up fee of will be charged to the holder of the account used to send any unsolicited e-mail. The clean up fee is will be determined at the sole discretion of HostTiger.


4. Refunds will not be issued for any services, if your account is involved in spamming activities.

Backups

1. Accounts on HostTiger servers are not permitted to be used for file backup or storage. However, you are allowed to have one cPanel backup of the same account.


2. Backups are provided on an as-is and as-available basis. You are solely responsible for maintaining local backups. There are no guarantees of any kind, either expressed or implied, as to the integrity of our backups. Backups will not be provided for suspended, terminated or accounts with excessive inode usage; unless otherwise agreed to in writing by HostTiger.


3. Backups are designed for disaster recovery. Should you, or a third party, request that the backup data held by us be used for a purpose other than disaster recovery, for example in litigation, we have no obligation to provide the data to you. Should we determine, in our sole and exclusive judgment, to provide the data to you, or should your data be subpoenaed or disclosure of it otherwise compelled, it will be provided at our convenience and you will be charged our prevailing hourly rate. You will also be responsible for any attorney’s fees we incur in reviewing, responding to, or producing your data. You may also be required to pay HostTiger a retainer to secure your obligations.

Payment

1. HostTiger accepts payments through a valid credit card or paypal before service is rendered; including renewals. Billing will continue on a recurring basis, until a cancel request is received through the customer centre.


2. You agree and understand 2Checkout.com, Inc. is an authorized retailer of goods and services provided by HostTiger. If payment is overdue for more than 3 days, HostTiger reserves the right to suspend or terminate the outstanding account.

Services
HostTiger services may only be used for lawful purposes -- any use of these services that violates any laws which may apply to HostTiger, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited. This means that while using the service, you may not: Post or transmit any unlawful, threatening, abusive, defamatory, obscene, libelous, offensive, pornographic, indecent, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or violate any law. Please email abuse@hosttiger.com if you believe your copyright or trademark is being infringed upon.

• Restrict or inhibit any other user from using and enjoying our services
• Offer for sale counterfeit merchandise of a trademark holder
• Infringe upon any copyright or trademark

We reserve the right to modify our services, or the way in which we provide them to you, should:

• A third party vendor cease making a critical aspect of the Services available to us;
• The Services be prohibited by law or regulation; and/or
• It becomes uneconomical for us to continue to provide them to you

Unlimited Disk Space & Bandwidth
HostTiger gives you freedom to grow your account without constantly worrying about disk storage or bandwdith usage. However, you still have to keep your web site optimized, so it does not “hog” resources such as CPU, RAM, or I/O. You're recommend to keep usage of CGI scripts, FTP, PHP, and HTTP, to a minimum. If your resource usage causes a service interference, your account may be suspended or you may be asked to order a HostTiger Private Server (VPS).

Resource Usage
HostTiger services are subject to capacity controls and various usage restrictions. Accounts are not permitted to initiate the following on our servers:

• Run background or other processes that consume excess resources
• Use excessive inodes & more than 30% of system resources for over 90 seconds
• Participate in any file-upload, sharing, archive, backup, mirroring or distribution activities
• Activate the account catchall email inbox. This feature must remain disabled.
• Operate a site created primarily to drive traffic to another site
• Run any gaming servers, web spiders or indexers
• Make account resources available to the general public
• Run cron entries at intervals less than 15 minutes
• Run any type of interactive real-time chat applications that require server resources
• Run any bit torrent applications, trackers, or clients
• Run stand-alone, unattended server-side processes, including but not limited to daemons, such as IRCD
• Run any software that interfaces with an IRC (Internet Relay Chat) network

60-Day Money Back Guarantee
HostTiger offers an unconditional 60 day money back guarantee. A full refund will be issued if you are not satisfied with our services and request cancellation within the first 60 days of payment. Refunds will be issued by HostTiger to the account holder credit card or Paypal account. This policy does not apply to additional services such as overages, maintenance, setup, dedicated IP, SSL certificates, and domain name fees.

Only pro-rated refunds will be issued for HostTiger accounts canceled after the first 60 days of payment. Accounts terminated by HostTiger for violating our Terms and Conditions do not qualify for the 60 day money back guarantee. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund. This is to protect our refund guarantee from abuse. To receive a full refund, please submit a request via the customer centre.

99.9% Uptime Guarantee
HostTiger will provide one month of FREE hosting if your web site is down more than 45 minutes per month. To receive this benefit, please submit a request via the customer centre within three (3) business days after the alleged service downtime.

One free month of service cannot be issued for service interruptions resulting from (1) ISP routing problems, (2) scheduled maintenance, (3) performance or failure of client equipment, facilities or applications, or (4) circumstances beyond HostTiger reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the customers web site. Uptime percentages will be determine solely by HostTiger monitoring programs.

Coupons
HostTiger discount coupon codes are only available for new accounts. HostTiger coupons are not valid with any other coupon or discount. Coupon must be applied at time of checkout and may not be used for previous purchases / accounts. HostTiger reserves the right to restrict or revoke any coupons at any time without notice.

Cooperation with Law Enforcement
HostTiger fully cooperates with law enforcement agencies. We choose, and in some cases are obligated, to comply with legitimate requests from law enforcement and other governmental entities for information about you. When possible, we will give you notice of these requests.

Warranties
HostTiger makes no warranties or representations of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by HostTiger or its agents or employees shall create a warranty. HostTiger provides no warranty that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free from viruses or other harmful components.

It may become necessary for HostTiger employees to examine system accounting logs and other records to determine if privacy violations or other network unfriendly activities have occurred. HostTiger also reserves the right to access files stored on HostTiger systems to resolve system problems.

Under no circumstances shall HostTiger be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from your use of or inability to use the service, or for third parties' use of the service to access your Web space, or to access the Internet or any part thereof, or your or any third parties' reliance on or use of information, services, or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with HostTiger service or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service.

Indemnification
You agree to use all HostTiger services and facilities at your own risk. You agree to indemnify, defend, and hold harmless HostTiger from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, HostTiger, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to domain name selection and web site content. You agree that you as the person legally responsible for all use of this account, are at least 18 years of age. If you are under 18 years of age, you need to have parental consent in order to sign up, and the account must be ordered by a parent or guardian, in their own name. You agree to supply HostTiger with a current and truthful name, postal address (P.O boxes not accepted) and telephone number for our records. You also agree that you are an authorized user of any credit card you supply to us, and you understand and agree we have an obligation to fully investigate any possible fraudulent credit card use.
